Manila Bulletin files counter suit - Yes its True..
I have been getting emails and sms about the story of yugatech.com - Manila Bulletin files counter against a photoblogger! yes its true.. I was hesitant to post it but while refrain from saying anything at the moment but just confirming that I finally got their counter suit and will prepare my reply.
The sms started yesterday and still get them as of this writing.. how do i feel? mixed emotions but the the fight for copyright and how this will affect any dealings with future copyright issues online pushes me forward.

Ask your legal counsel about any precedent in Filipino courts to counter-counter-file against Manila Bulletin (or MaBu as I’ve taken to calling them) for barratry or abuse of process. You know this already, but ganking a photographer’s work to use as feature material in a for-profit publication without attribution or stated permission is definitely well outside the bounds of “fair use.”

Fuck Manila Bulletin. Their so called newspaper is a knock-off of any other american newspapers, they should be paying those fuckers money too!
They call themselves journalist but they fucking steal content and images. What a bunch of fucking amateurs.

I guess it’s just SOP by the major daily’s lawyers - when being sued, immediately counter-sue. It’s just legal tactics. IANAL, but I hope they don’t start buying out judges because any judge in his or her right mind should know who has the moral high ground here…

I blogged, plurked, and tweeted about this. You guys should, too. Keep the fire burning until no one can turn their back on the issue, media included, and MB’s moral authority will be severely questioned, just like the Malu Fernandez issue.

You are not aone.
Mind you, the Manila Bulletin is not the only publication that infringes copyright. Another publication recently infringed a copyrighted photograph from our website. We sent them a demand letter and the editor of the section has not replied in any proper way whatsoever. He never even apologized. Gets me wanting to ask him, “TAO KA BA?”
They cropped out our watermark but forgot about the watermarks on the license plates with our logos.
They instead acted upon it by issuing a stupid “erratum” apologizing for the error. It is NOT an error. It is a malicious violation of copyright which as a respected major daily they should be responsible. The photograph was never authorized for publishing nor did they ever ask permission.

hey anton - good luck and i’m with you on this! i think this is going to be something that will help all photographers.
One thing that all of us could also benefit from this is - what exactly are our rights for our photos here? How can we file for a copyright? I saw that there’s a law about it but I have never read it. It’s time for me to be familiar with that.

mabuhay ka! it’s about time that these publication/s who have the habbit to have a “free ride” on pix which are not their property, to have a good challenge.
