Online Photo stolen used for Earth Day Jam Poster.
Anyone familiar with this poster? Its all over the City.. in preparation for the Earth Day Jam scheduled on April 25, 2008. The violation wasnt only for the poster that was displayed.. the said image was also used for a TV commercial and a newspaper ad of said the event.
What did they do? they covered the girls face with a globe.. does that make it a new image? nope i beg to disagree.. the work below falls under derivative work and the original copyright still stands.. I wonder what the artist was thinking..

It just gets worse and more rampant.. why do people steal photos? is it because they think they can get away without getting caught?
The Internet is full of resources especially photos, is it really that hard to ask permission? Am sure any photographer would be more than willing to help out especially in a case like this for Enviromental Awareness. I wonder how many images used in that poster was downloaded..
Just a week back, we had ABS CBN on the spotlight for using photos without permission from another website but ABS CBN has moved to settle the violation with the said website and photographer.
Unlike my story about Manila Bulletin stealing my Photos, instead of trying to settle with me, they even sent me a letter to stop any talks about their violation or they will file criminal charges against me…. hmm i wonder for what charge? The organizers are only wrong in this regard only because they have overlooked the work of the graphic artist that they hired. Apparently, this graphic artist said that he had gotten the image from an image bank. Whether or not it was true, the organizers knew that they were wrong and immediately spoke to the photographer.
They asked her if she wanted compensation, credit, whatever she wants, but she did not give an immediate reply.
the news spread and all the organizers were left was a tainted reputation. It was the graphic artists fault but they were taking the blame because whoever the leader is should take the fault of the followers. They said that a certain boy named Dae, from UA&P called up their office and told them that he was Patricia Gosingtian’s boyfriend. Assuming that he called regarding the issue, they asked him again what they wanted, credit, compensation, whatever they want. He couldn’t give a straight answer. Instead he asked for 2 VIP tickets to the said event.
The organizer was happy to give the tickets and it was not in her mind that it would be the form of payment for the photo, but as soon as the phone was put down, news spread that the organizers only gave 2 VIP tickets as a form of payment to the photographers, which was not the point.
The only demand that these organizers got was from the mother of the model. She specifically requested that there should be another poster printed so that her DAUGHTER’S FACE WOULD BE SEEN. Because, according to her, her daughter is a famous model.
Up until yesterday, the organizers still have not gotten any reply from these kids. While there is indeed injustice done, I think these children are using this issue to just further their online popularity which is obviously the case now and has nothing to do with settling the business side of things.
Even if they claim that a formal letter is being written as of this moment. I very much think that this is a simple matter and could have been settled immediately. They keep complaining about people who don’t hire kids because they lack professional experience despite the talent, well, there’s your answer.
What they could have done is settled this and offer future services to these production companies, who may want to get them in the future considering that their work is obviously applicable to the events that they do.
If you want to confirm this, call the organizers office and they will tell you how these children have dealt with them. The organizers are very nice people and have worked in this industry for a very long time now, I’m sure they know what is right from wrong.

The model in the photo has done her own copyright violation in the past, from Mango Jam magazine. She took photos on the web and claimed it as her own. The magazine has apologized to the owners of the photo/s.

I think you can contact the magazine website to confirm this. I just find it odd that they are reacting very irrationaly on this issue when the parties concerned have done something similar in the past. I think they would know how to handle this by now.

Thank you for sharing your comments on the story.
The model is different from the Photographer, In this case the organizer infringed on the right of the Photographer by using the photo without permission. a clear violation of copyright.
Pointing out that the model in the photo has her own copyright violation is an entirely different story.
If you represent the organizers or can contact them maybe you can suggest that…
The best solution to this whole mess would be for the organizer to set a meeting with the concerned party and try to settle this amicably.

About my issue with the copyright infringement with Mango Jam, I was only about 15 or 16 yrs old back then and I had no idea about copyright infringement for that matter. (To prove my point, writing academic papers along with crediting sources was only taught around late 3rd year of high school.) This is a different issue from when commissioning a Professional Artist who may at least know the knitty-gritty details about art/photo usage. BTW, the only person who complained about it was Aaron Roselo who is neither the owner nor the model. And besides, Mango Jam, in my behalf, has apologized publicly regarding that matter.

I cant stop think ” why these so called photographers whining about their works being stolen.” yes, we have to protect our works, it is our right to, it is us who made it.
there too many thieves out there nowadays, I think we should be more careful.
If we don’t want our works to be stolen, keep it, protect it, just like protecting you testicles by wearing a armored underpants. posting photos in the international network [the WEB] is a dangerous, its like parking our cars with their keys and putting a sign “HEY THERE, DRIVE ME” or putting a hundred gran in the middle of the street and blindfolding yourself so you wont see anything.
we must be responsible on every action that we do. I dont agree on what these thieves did. but, we should all think that things that are happening now are just reactions on what actions we did. never blame anyone but yourself./BP

To clear things up, I, indeed, talked to the organizer,Lou Bonnevie, last week and politely REQUESTED(I DID NOT DEMAND) that if it is impossible for them to put down the tarpaulins/posters, because the photo they used was stolen, then probably they could make new ones with Alodia’s head back. As a mother, it saddens me to see a picture of my daughter headless.I did NOT say that my daughter is FAMOUS.The only thing i remember casually telling her was that , Alodia’s website has over a million page views that her friends and supporters have been continuously sending her messages expressing their disgust over the blatant display of her annoying/horrible photo all over the city. Lou must have misquoted me for telling her that Alodia is known in the anime/gaming/cosplay and Deviantart community. I am sorry if I seem to sound like one proud mother but the conversation that transpired was friendly, modest and polite. Again, i emphasize that I DID NOT SAY THAT MY DAUGHTER IS FAMOUS. I also mentioned if they could render a Public Apology to Tricia since she is the Photographer and the rightful owner of the photo in question. But these requests were unfortunately turned down. All they could offer are VIP tickets to the concert and an announcement of the proper credits to be done during the show. I couldn’t divulge any further as Tricia and her lawyer are taking over the driver’s seat on what legal action to come up with after their formal letter was also being ignored. Hoping I made my side clear. God bless!

Before you comment, please set your facts out straight. I never said to them that Patricia was my girlfriend. And I never asked for VIP tickets. I just asked some information about the artists who made the poster but never asked them to give anything in kind.
And I am sure the company has gotten a reply from them.
As of this moment I am contacting the company as the External Vice President of UA&P’s SEB regarding the school’s participation on their event.
Please don’t assume that we are unprofessional or have no experience because of facts that are just made up.
I myself work in a company and I know how things go around.
Please don’t give out false information such as this that would affect all parties and innocent individuals.
Sorry to say, but maybe you should call the organizers so that you would be saying things that are factual. Since you are the one who is being unprofessional.

I feel sad on what happened to the earth jam poster, as a photographer I know this can easily happen to either one of us, but what you did in the past is not much different, its just this is of a larger scale. Ignorance of the law doesn’t excuse the fact that what you did was illegal, so rather than going offensive on your previous act and take the “I didn’t know it was wrong” attitude, I suggest you suck up to your mistakes so we can all move on and help you with this current situation.
Honestly the first time I heard about the earth jam poster, I was ready to exhaust my means to help out, but after seeing your replies, arrogant at that all I can say is “KARMA”

Hey Buck Pago,
You might try to consider that not all people are thieves and dishonest. There are still people out there that need not be blindfolded to not take a hundred gran when he knows it isn’t his. There are still people who believe and follow the system and hope that others are still honest too.
I beleive the photographer posted her picture on the net beleiving that too… for other honest people to see so that she can share whatever message she wants to convey. It is so sad that others abused that trust made by the photographer to the people whom she wants to share the photo with (the public). However, suggesting that the photographer “keeps his testicles in an armored underpants” would dampen the spirit of the photographer in sharing the message she wants to convey. We don’t want to be a paranoid because others are abusive. That is why we there is a legal system. Hopefully, justice will be given to the photographer if indeed this is her rightful copyright along with the appropriate relief, and sanctions and penalties be served to the offending parties.

Theft is aweful. Buck Pago, it is wrong to ‘copy and paste’ things off the internet and call them your own. ESPECIALLY if you use it for commercial purposes. Just because you don’t know the person you rob, or you don’t think you will get caught, or the person you are robbing cant afford to put the smack down on you, doesnt make it alright to steal. If this photo was cut out of the latest issue of Rolling Stone Magazine, you can bet the organizers would be in some hot water. Do you think Rolling Stone constantly worries about people swiping their photos/articles? I would hate to live in a world where armored underwear would be necessary.
